In a nutshell, the answer is no. Was the creditor listed on your schedules and creditor matrix? If so and the debt was for the period before your bankruptcy was filed, you should notify your bank and the creditor and supply both with a copy of your discharge and a demand that the levy be withdrawn.

Just because your case has been delayed is no reason to change lawyers. If the delay is not your lawyer's fault then how would changing lawyers make any difference? You need to find out the reason for the delay.

This isn't as simple a question as you might think. Only a lender will can repossess a vehicle, and for a lender to do this while you are in bankruptcy, they must obtain permission from the bankruptcy court based on nonpayment of the loan or failure to maintain insurance. Many large vehicle lenders require a reaffirmation agreement to be signed before the bankruptcy is discharged or they will take the vehicle back even if the payments are current. If a vehicle has equity, state laws called exemptions determine how much equity (value minus the loan balance) a person may have to keep a car from being taken to satisfy other creditors. In Nevada, you may have $15K in equity in a vehicle before the bankruptcy trustee will want a piece of the car. In many instances, payment arrangements can be made to keep the vehicle, even if the equity is over the allowed amount.
