Can I file for bankruptcy on debt that I owe to pornographic websites?

Answered by attorney Deborah Ann Stencel (Unclaimed Profile)

While it is possible that more information is needed to be certain, that seems like the kind of debt that can be discharged in a bankruptcy. The exceptions to discharge you are vulnerable to include incurring a debt with no intent to pay (I.e., fraud). It is possible some these sites are not United States-based which does add another layer of complexity. I hope you are doing better now. Consult with an attorney, bringing any letters or notices and information about these debts that you can bring.

If I file Chapter 7, will my son also be obligated to file since we are joint owners of the home?

Answered by attorney Paul Norwood Jonas Ross (Unclaimed Profile)

No. Your son will remain liable on the credit loan against the home. But since it is secured, you will have to make payments on it anyway to keep your home.

What can we do if its only our second mortgage that was reaffirmed with chapter 7 and not our first?

Answered by attorney David Justin Harelik (Unclaimed Profile)
Bankruptcy lawyer at Westgate Law
You are right that the 2nd lender has violated the FCRA. You have rights and you need an attorney that can handle them. You are out of luck on the 1st mortgage since you can't reopen the bankruptcy case to address the first reaffirmation agreement, but you absolutely can address the 2nd mortgage. I would not send more than one letter to the 2nd showing that you reaffirmed the loan. If they did not fix it within 30 days, I would bring an FCRA claim against them on day 31 as well as a claim against them inside the bankruptcy.
