Will I get help to vacate the home if I sign a stipulation after foreclosure?

Answered by attorney William Monroe Rubendall (Unclaimed Profile)

This sounds like what is called "cash for keys." It means you get some money to willingly move out after foreclosure. Something is better than nothing! If you don't agree then normal eviction procedures would pertain. At any rate, there is a matter of just a few weeks delay if you contest an eviction. You may have already lost certain rights if you have not answered the complaint to evict. Take the money and use it to help moving expenses.

What does a signed substitute trustee’s deed mean on a mortgage loan after our bankruptcy was discharge?

default-avatar
Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
It should have no effect on you. When your debts were discharged, your personal liability for the loan was eliminated. Assuming that you did not sign a reaffirmation agreement, you have no personal liability for the loan. However, the property is still liable for the loan. Each Deed of Trust has a trustee. It is not unusual for trustees to be substituted. Each time that happens, a document must be recorded letting the world know who the new trustee is. That has no effect on your liability and your lender should know that.

How will filing bankruptcy affect my spouse who does not need to file?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Bankruptcy lawyer at Steven J. Alpers, A Professional Corporation
If you file you have to give information about your finances and your spouse's finances. It may be difficult to keep it away from your spouse and she may have to fight the issue.
