It would have helped if you had indicated whether or not there was any relationship between the debtor and the party buying the vehicle. In a sale to a neutral private party or dealer, this might not be any problem at all, but if the sale was to someone related to the debtor, it could have serious consequences.

There is no filings required in the bankruptcy from a cosigner. You should be aware that you are now solely responsible for the debt.

I only work on Chapter 11's, so I don't know the answer to your question directly. At my firm, we have an attorney that used to work for the Chapter 13 trustee, so she knows the answer to questions like these off the top of her head. From the answers you have gotten, I can tell each attorney is looking at it from a different perspective. Each is trying to protect one thing and not another etc. No way anyone can tell you which attorney is right without looking at the details. The way I would pick an attorney is see which one you believe CARES about your situation and that you TRUST, expertise comes third to these two. If you have not found one you trust, or that you think cares, move on.
