Will I have to move if my ex files bankruptcy?

Janice Fabiana Alfred
Answered by attorney Janice Fabiana Alfred (Unclaimed Profile)
Bankruptcy lawyer at South Atlanta Family Law
If she decides to reaffirm the loan, it will survive the bankruptcy. However, if she does not reaffirm she can keep the house and both of you can continue to live there, as long as someone continues to make the mortgage payments on her behalf. The good thing is that if she decides later on that she does not want the house for what ever reason (e.g., she is upside down on the mortgage), she can simply walk away with no liability for the loan since it was discharged in bankruptcy.

Can a trustee take my wife's car if I file for chapter 7?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)
Bankruptcy lawyer at Orantes Law Firm
The short answer is that it does not seem likely. However, you should consult an expert bankruptcy attorney to get a definite answer under your particular circumstances. With that said, most debtors usually retain all of their property, including cars, and if we're dealing with the separate property of a non-filing debtor, with more reason.

How much time do I have between completing all the bankruptcy documents and filing for bankruptcy?

Generally, if you have an attorney prepare your petition, the attorney files it for you to make sure it is filed properly. Your credit counseling certificate must be received no more than 180 days before your petition is filed or it is stale. If you are going to file the documents yourself, make sure you speak with your attorney first to make sure you fully understand what is required.
