If you understand that your student loans will probably not be discharged, it sounds like you are in a position where you should at least find out from someone who can run the numbers for you if bankruptcy is good for you.

When you file bankruptcy, you must list ALL of your debts. You cannot pick and choose who you are going bankrupt on. But you can choose to reaffirm debts. Thus, you cannot file bankruptcy just on debts you believe to be fraudulent.

The non-exempt funds remaining from the personal injury settlement will be used by your Trustee to pay creditors of the (joint) bankruptcy estate, which includes your creditors as well as his.
