You do NOT have to be dead for creditors to be unable to get money from you. As long as you keep your SSI income in a separate bank account and never EVER add money into the account from any other source, only the IRS and possibly your student loan company can take this income. If you have a federal student loan, talk to the collector about options to have the loan payments deferred or even eliminated. Your kid would NEVER get over losing a parent over something as inconsequential as debt. While bankruptcy is always an option, frankly, bankruptcy may not be something you need to defeat the creditors.

The issue isn't how soon after you file a bankruptcy can you put real estate in your name. The issue is when did you obtain the legal right to do this and where the money came from. If you are purchasing real estate with money you earned after you filed bankruptcy, the bankruptcy isn't an issue. But if something else is going on, you will want to have a follow up consultation with your bankruptcy attorney to be sure you don't have any problems.

Bankruptcy law requires a reaffirmation to be filed and approved by the court before the discharge is entered. If you are asking this question because your mortgage company has told you to do this, you may have the right to sue your mortgage company for damages and force them to provide you with an attractive reaffirmation. Hire an experienced attorney for your loan modification case. Your legal fees can be largely covered by the damages awarded to you from the mortgage company and you may have very little out of pocket expense.
