Based on 20 years of trial work, I'd say your chances of proving him guilty of fraud are about 1,000 times better without him there than they'd be if he was. It's much easier to deflect liability to "the empty chair" than to someone who'll just get on the witness stand and deny everything you accuse him of.

I don't see a question here, and there isn't enough information to answer what I think you're asking. What is your relationship to this case?  Are you the debtor?  Are you a creditor?  Are you representing the debtor, or a creditor?   Different answers for different relationships.  If you're a creditor, it's likely in your best interest to report the bankruptcy fraud, but I don't see how you have any legal obligation to do so. The filing fee for a chapter 7 is $306. Attorneys fees vary. You can file bankruptcy and keep the home as long as you pay the mortgage. You can get out of the credit card debt and most all other debt.
