If the debt was incurred through fraud that was proven then no you cannot discharge the obligation in a chapter 7. You can pay it over a five-year term in a chapter 13 if the payment arrangement is a hardship to you.

Question: Can I convert a Chapter 13 to a Chapter 7 when the case was originally filed as a 7 and converted to a Chapter 13? Question Detail: I filed a Chapter 7 petition in 2010. The trustee challenged the means test figures and after debate it was agreed that I would convert to a Chapter 13. The Chapter 13 was confirmed and I made payments up until August of 2012 when I lost my job. I want to convert back to a 7. I tried to file a Notice of Presentment for a conversion Order but was told I have to make a motion but more concerning is that I have to file a new mean test using the numbers from the date of my original filing not now. I lost a low six figure job. My severance is done. My unemployment is all I have. What can I do? *- who told you that you have to use the OLD income information? The norm is that the CMI (current monthly income) for a Chapter 7 is to review the immediate 6 months of gross income prior to the month of filing. The norm for a Chapter 13 is to review the DMI (disposable monthly income) available for the previous six months prior to the month of filing. There's more to it than that, however, those are the basic rules of income determination. I'd have to know WHY you think you need to use your old income figure from a job you no longer have. *
