See an attorney on the procedure to do this correctly. It will either be under contract or under statute. While you are doing this you should revise your forms and customer agreements to avoid this issue in the future.

If my spouse cannot pay his credit card debt, can the credit card companies make me pay instead of him?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
While your name is not on the debt, they may seek payment from him through assets you own under our community property laws. In other words, if you own assets with both names on it, they will attempt to recover after obtaining a judgment from those assets.
