I'm glad you had the surgery. Life with pain is no life. You can file bankruptcy. Student loans aren't dischargeable unless you can't work at all. Medical bills and credit card bills are dischargeable. But please see a lawyer for help with filing; otherwise you could screw yourself and cost yourself a lot more than a lawyer would charge.

When filing for bankruptcy, a debtor should never transfer valuable property out of their name prior to filing bankruptcy. This could be considered a fraudulent transfer and a bankruptcy trustee may actually reverse the transfer and sell the property if it is not protected by bankruptcy exemptions.

The right to collect a preference belongs to the trustee, that's the 90 days you are referring to. However, the wages may have been exempt, the employer might still be holding the funds if no final judgment of garnishment, and if the trustee does not claim the funds and these are exempt wages, there is a procedure to demand turnover of the exempt wages, but that would involve a complicated procedure.
