Can the lean holder file suit against the co-signee?

Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)

In California, most mortgages are resolved by non-judicial foreclosure (sale of the property at auction). By taking that action, the lender does not have a deficiency claim against a co-signer. However, if there was a junior lien (2nd or 3rd) that was eliminated in a foreclosure, they could sue the co-signer. The co-signer should see an attorney so that the facts of this particular matter can be analyzed.

How do I respond to a summons for bad credit card debt?

There is a statute of limitations of 4 years. This is a defense that you can raise in the hearing. If you lose the case you can still file bankruptcy and include the judgment. If you cannot afford an attorney there are clinics in some areas to help. You can file your own bankruptcy, however, have an attorney review the papers before filing them.

What can I do if I can't afford chapter 13 payment and my attorney won't help?

Charles J. Schneider
Answered by attorney Charles J. Schneider (Unclaimed Profile)

Sometimes an amount has to be paid in a chapter 13 case whether one can afford it or not to reach a goal that the client wants. Sometimes attorneys who receive a flat rate and do not charge by the hour will not respond to client phone calls as they do not make any more money for doing so. Sometimes attorneys do not wish to take over another attorney's case because the attorney that they replace may have messed the case up badly and there will be disgruntled clients that have lost their faith in attorneys in general and therefore will be difficult.
