When one files Bankruptcy, does that relieve them of paying a Court Ordered payment through n Divorce?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
It depends what type of bankruptcy you file and why type court ordered payment it is. If it is a support payment, such as child support, spousal support or alimony, no bankruptcy can discharge this obligation. However, if it was a property settlement or debt division order then those can be discharged in a chapter 13 bankruptcy after plan payments have been concluded.

Is deferred compensation like pension and Individual Retirement Arrangement exempt in a bankruptcy?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Bankruptcy lawyer at Graves Law Firm
IRS qualified retirement programs are generally exempt. A bankruptcy lawyer can review your plans and tell you if they meet the requirements for the exemption, but they very likely do.

Can you file bankruptcy on payday loans in Houston?

Susan Green Taylor
Answered by attorney Susan Green Taylor (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Susan G. Taylor
Cash advances within 90 days of filing are presumptive fraudulent. But beyond that payday loans are dischargeable, absent fraud. If you took lots of them & paid nothing back, your filing might be considered fraudulent but the burden would be on the creditors or trustee to prove such fraud.
