How do I or where do I list the co-signed loan for a friend to get a house in my chapter 7 bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)

If the property has not been foreclosed on, you list the property on Schedule A, the mortgage debt on Schedule D and your friend on Schedule G. Use the best name & address you can find for the mortgage company. Your credit report may be a good place to start.

What is the name of the form to amend?

It all depends on the type of creditor. If it is an unsecured creditor you would need to amend Schedule F to list the creditor. If it is a secured debt then you would need to add them to Schedule D and amend that. If they are a priority creditor you would need to add them to Schedule E. Once you add them and amend the schedule you should also file an amended creditor matrix so that when the case is discharged the court will mail them a copy of the discharge order.

Can a married woman in California file chapter 7 on her own?

default-avatar
Answered by attorney Asaph Orion Abrams (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Asaph Abrams
A spouse may file bankruptcy separately from her spouse. However, separate-filing is a yellow wet-floor-sign: it's slippery when wet. A waiver may be necessary and debtors often fail to appreciate that the nonfiling spouse's assets and income are integral to the filing spouse's bankruptcy. The decision whether to file jointly or not is not straightforward; you should both consult with counsel. Don't let the national credit-score-obsession strictly dictate your moves.
