How will bankruptcy affect my taxes?

David Michael Benson

Generally speaking, discharge of your debts in bankruptcy is not income for tax purposes and should not be stated as income on your tax return. And although most taxes are nondischargeable, some income taxes are indeed subject to discharge under certain circumstances. You should arrange for a free consultation with a qualified bankruptcy attorney in your area to discuss your particular situation.

Do I still need to list al of my assets in the petition?

Diane L Drain

Yes, filing bankruptcy is like being pregnant. You cannot be partially pregnant. Therefore, you will swear under oath that you listed 100% of all your assets and 100% of all your debts. Of course in the asset group there is no reason to count the number of socks, but do list clothing. Disclosure is the best advice. Second best advice - retain a lawyer to help you.

Bankruptcy is a constitutional choice. "Can you file" - most likely. The important question is really "should you file"?
