Are my credit cards included in my Chapter 7 filing?

All debts are included in your bankruptcy. If you omitted a debt you need to file an amended schedule to include it. Nothing in the bankruptcy code prevents you from making a voluntary payment for a discharged debt.

If one has filed for personal bankruptcy over 10 years previously, is a second personal bankruptcy available after the 10 year period?

Answered by attorney David L. Gibbs
Bankruptcy lawyer at The Gibbs Law Firm, APC
Anonymous, just so you feel comfortable with the answers given, 10 years following your prior bankruptcy, you are able to file a new bankruptcy and obtain a discharge. If you want a run-down of the various time-frames (depending upon the prior chapter and current chapter), feel free to contact one of us directly. Also, before filing bankruptcy you should consult with a local bankruptcy attorney. Most offer a free, initial consultation during which you can get some answers to questions you may have about the process, including whether you qualify for relief. Further, often times you will be surprised at how affordable most bankruptcy attorneys are. When you are considering a legal proceeding that can eliminate thousands of dollars of debt, or not depending upon whether it is handled properly, you would be well served to at least speak to an attorney. Good luck. David L.
