If I file bankruptcy, can I keep my car that is in title pawn?

Jeffrey Alan Cogan
Answered by attorney Jeffrey Alan Cogan (Unclaimed Profile)
Bankruptcy lawyer at Jeffrey A. Cogan Chartered, a PLLC
You would have to file a Chapter 13 to get your car back or the title pawn company may agree to a reaffirmation agreement in a chapter 7. Chapter 13 is where you pay some money to a trustee for three years and chapter 7 is where you don't pay and you are done in four months.

If you signed a loan contract with an employer and the fire you, would that be considered breaking the contract?

The terms of the contract will determine the answers to these questions. If you signed an agreement to make payments and failed to make one, even if it is because you are no longer employed, you probably still owe the money and if you fail to pay your employer CAN sue you. If the debt is $7,500 or less, it is a small claims matter.

Will I have bankruptcy exemptions on workers comp settlement?

Answered by attorney Karen Jackson Porter
Bankruptcy lawyer at Porter Law Network
I am so sorry you are getting different answers. It seems that something like a workers comp award should be exempt in Illinois and it is exempt. The exemption is not contained in the Code of Civil Procedure. The exemption is contained in the workers compensation act. The exemption needs to be properly claimed or it is waived. Since there is an exemption for the workers compensation award, you would not need the wild card exemption, which is $4,000.00. I hope this information helps.
