What will happen if my husband files for bankruptcy?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Get an attorney and file for the divorce and in it seek to have the debt for the car assigned to him. Then, even if he bankrupts he will have to "hold you harmless" the damages you may incur.

How do I refinance my home to a lower interest rate after filing chapter 7?

default-avatar
Answered by attorney Paul Norwood Jonas Ross (Unclaimed Profile)
Bankruptcy lawyer at Paul N. J. Ross Law, PLLC
This will entirely depend on the lender. Some lenders require a reaffirmation agreement, some do not. To refinance usually does not require a reaffirmation agreement. The difficult part is rebuilding and establishing your credit sufficient to qualify for a refinance.

How do we get the $20,000 that my cousin borrowed from our father?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
You may, but it is not possible to tell from the facts given. Things to consider: 1. The statute of limitations on a contract wholly in writing is 10 years. 2. The statute of limitations on a contract not wholly in writing is 5 years. Both periods are measured from breach, are restarted by payment, and may be extended by at least a written acknowledgment. 3. A contract which is not by its terms capable of being performed in one year must be in writing, signed by the party to be charged, to be enforceable.
