Will filing for Chapter 7 Bankruptcy prior to the deadline to respond (5 day) delay an eviction action?

There are special rules and you have to disclose the eviction. It probably will not stop the eviction if the sheriff's notice of eviction date has been posted on your door or if there is a judgment.

If you signed a loan contract with an employer and the fire you, would that be considered breaking the contract?

I don't see which contract words the employer violated or 'breached'. Does the contract state that you will continue to employed until the loan is paid off with the payroll deductions? Unless there are words in the agreement that require the employer to keep you employed there until the loan payments are done, I don't see any breach.

Will the co signer be liable if my son files for chapter 7 bankruptcy?

default-avatar
Answered by attorney Deborah Ann Stencel (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Deborah A. Stencel
Yes. If your son files Chapter 7 and does not continue to pay for the truck, his debt will be discharged but the co-signer's liability remains. The most likely scenarios is that the truck will be repossessed and sold at auction. The auction proceeds will be subtracted from the loan balance and the deficiency balance can be obtained from the co-signer. This will also negatively impact the co-signer's credit in all likelihood. In this situation, all the co-signer can do if make arrangements to pay for the car herself or to file a bankruptcy of her own. Sorry to be the bearer of bad news. Best wishes.
