If I file bankruptcy, can I reaffirm one credit card so I may keep it if it has a zero balance?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
If you owe nothing on that credit card, you do not have to list it in your bankruptcy. You would not need to reaffirm it. You do not have to agree to pay something that you do not owe. There is nothing to discharge if you owe nothing on that credit card. Make sure the balance is zero when you file. You have to have a consultation with an approved consumer credit counselling agency before you file, and get a certificate from them that they have consulted with you. If you are married both of you need to get certificates.

Can he file bankruptcy and does it in any way affect my credit or the loans?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
If someone qualifies to file bankruptcy, it is their decision to make, not yours. Should your ex spouse file, it would remove his personal responsibility to pay these debts. If you intend to retain the car & the home, you will just need to continue to pay for these loans. It is unlikely that his bankruptcy would affect your credit, but mistakes do sometimes happen, so monitor your credit carefully for the next year. If his bankruptcy migrates on to your credit, you should dispute this misinformation right away.

What is bankruptcy and how can it help me?

Cary Sawyer Smalley
Answered by attorney Cary Sawyer Smalley (Unclaimed Profile)
Bankruptcy lawyer at The Smalley Law Firm, LLC
Student loans generally cannot be discharged in bankruptcy. Bankruptcy can discharge most unsecured debts, including credit card debt and medical bills. I suggest you consult with a bankruptcy attorney to discuss the details of your situation.
