Can a creditor still collect after bankruptcy?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
The Automatic Stay stops your creditors from taking any action to collect against you. This includes garnisheeing your wages. Prepare and file a Notice of Automatic Stay in the Court in which Citi sued you, and provide a copy of said notice to your employer to stop the wage garnishment. If possible, it would be best for you to have expert bankruptcy counsel to assist you in this and any other matters that may arise in your bankruptcy case. Feel free to call me for a free consultation.

When he files for bankruptcy, will the house fall back on me or what will happen?

Answered by attorney Ronald K. Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
Bankruptcy doesn't change the ownership of real estate (except in rare circumstances). The house will still be jointly owned by the two of you and the bank will still have a mortgage lien against the house. The difference will be that your husband will no longer be liable on the mortgage but you will still be liable.

What retirement funds are exempt from chapter 7

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Pretty much any qualified retirement funds are exempt in bankruptcy.  There is an upper limit for some types of somewhere around $1 million, but I've never had a client who had that much.
