The only right to rescind in 3 days is on a home improvement contract sold to you at your house. If you have not been given what you were promised you can rescind, demand your consideration back, return anything you received and then sue when the other person fails to restore your consideration.

I moved in to a place to then find out that the hoa was renting out apartments that had leins on them and had evicted the owner.

If the HOA has only a lien against the property, then they do not have the right to rent the property. Only if the HOA foreclosed it's lien and now owns the unit can they rent the units to tenants. I would insist that the HOA show you a deed proving ownership of any unit you are renting. If they cannot produce it, contact the Fair Housing Department for the City or County where you live, and file a complaint. Also, start looking for a new place to live. David L.
