This is a good question. I guess the real problem would arise when a creditor gets a judgment against her and seeks to take her deposition, but she does not show up. She could be held in contempt of court and placed in the custody of the sheriff. This is the prime thing that we would want to avoid. Filing a bankruptcy would make it so that this could never happen, it would wipe all of her debt off the slate. It costs $306 to file a chapter 7 for the filing fee, and a reasonable attorneys fee is around what I charge, $1200. So, for about $1500 a chapter 7 can be accomplished.

Normally a chapter 7 bankruptcy has little to do with a house. If you want to keep it, and it has no excess equity over your state exemption, then you do as you please. If you decide to sell it you must pay the debt(s) secured. You also should check to determine if the bankruptcy file is closed. Most title companies in Arizona will not complete a sale until the bankruptcy is both discharged and file closed. My best to you.

Bankruptcy may offer you some relief from your student loan debt, but it is a more difficult problem to resolve than medical debt or credit cards. Student loans cannot be discharged in bankruptcy unless you can show that not discharging the loans would cause an "undue hardship", and this has been interpreted by bankruptcy courts to be a very high burden. Only a handful of people get any student loans discharged in a given year. However, you may have a good case to discharge at least a portion of your student loan debt. Chapter 13 may also offer you some temporary relief by preventing collections by the student loan creditors while you make a minimal monthly payment. However, this can only last for a maximum of 5 years, at which point you will probably be farther behind than when you started the bankruptcy. It may help you buy time to find better employment, or it may also help you to demonstrate that your student loans are an undue hardship.
