When filing for bankruptcy if you have a car that you own but are still paying payments on, will they reposes the car?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)
Bankruptcy lawyer at Orantes Law Firm
Not unless you want them to. You will need to reaffirm the debt, which means that the car loan sails through the bankruptcy process unmodified, but you neither need to surrender the car nor does the lender get to repossess it simply because you filed for bankruptcy protection.

Can a creditor collect from one party when more than one party is legally responsible?

Yes ... generally the liability is joint and several.. the one creditor being sued can always file a third party complaint against the other debtors if they want for contribution to pay their fair share of debt.

Can I file bankruptcy on custody battle attorney fees?

You can usually discharge your own legal fees in a bankruptcy. But the next time your ex brings a suit to harass you, you will probably not be able to find a family attorney to touch your case with a 10 foot pole.
