If I am already paying a collection agency but they want more, can they garnish my wages?

default-avatar
Answered by attorney Austin M. Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
If the creditor has a judgment you can file a motion with the court to make installment payments on the judgment. The motion should list your income and expenses and indicate what you want to pay on the judgment. The rule of thumb that some courts apply is that you should pay 25% of your disposable income. If the court grants your motion and you enter into an installment payment order that order will stop wage garnishments. The installment payment order will not prevent the judgment creditor from filing garnishments against money you have in the bank and levying on personal and possibly real property that is titled in your name.

Do Commercial Codes 2313-2317 (on warranty) apply to a business when it goes out of business?

Bankruptcy lawyer at Steven J. Alpers, A Professional Corporation
Contact your bankruptcy attorney. It may depend on whether you listed the customers in the bankruptcy. Are the customers just asking for a warranty or are they making a claim now. Can you legally act as a contractor or did you lose your contractor's license as part of the bankruptcy. I would not make any agreement for a warranty. I do not perform legal research on this issue and will not unless paid an hourly fee. These are only preliminary issues.

What will happen to my irrevocable trust if I file personal bankruptcy?

default-avatar
Answered by attorney Tony E. Carballo (Unclaimed Profile)
Bankruptcy lawyer at Carballo Law Offices
You cannot "inherit" an irrevocable trust. Maybe you mean someone, such as your parents, created such a trust and named you as beneficiary. In that case the trust is an asset of yours because it is irrevocable. Determining the value of the trust is not easy if someone else, such as your parents for example, have the right to possess and enjoy the assets of the trust while alive or for a period of years. If the trust property is all yours now without restrictions then the property can definitely be sold to pay your debts unless you can exempt the property. You need to obtain legal representation to handle your bankruptcy case and may need to consult with the attorney who drafted the trust or another lawyer who handles trusts and estates.
