One spouse can file bankruptcy on his or her individual debt. But if the debt is joint then the other spouse will certainly be affected.

Can I file charges against someone who has included me as a creditor on her chapter 7 bankruptcy?

Does she owe you money? Did she steal it? Bankruptcy is a protection against creditors, so you're probably out of luck.

Why would anything happen to "a lawyer"?   If a creditor is secured and incorrectly listed in the schedules or a Plan, they can take whatever actions are necessary depending on which bankruptcy chapter was filed.  Usually nothing needs to be done.    Are you asking on behalf of the attorney's client, or someone else?  Your question is very vague. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.  CONTACT MARK for more information or to schedule an appointment.
