Can my husband file bankruptcy without his co-signer?

default-avatar
Answered by attorney Natella Royzman (Unclaimed Profile)
Bankruptcy lawyer at Royzman Law Firm
He does not have to, and in fact cannot, file bankruptcy jointly with his ex-wife. If he files for bankruptcy, he can discharge his personal liability for the debt. The liability of the co-signer will not be affected.

If death certificate is supplied, does this clear the debt?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
Supplying a death certificate does not extinguish the debt, but that plus a statement that there is no estate or assets and that the relatives do not want any further contact should result in cessation of collection activity, because there is no one to collect from. If there are further attempts to collect, such as from survivors, they may violate the Fair Debt Collection Practices Act.
