Can I cancel the chapter 7 because I cannot enter into a payment plan at this time?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
You can try, but it could be very difficult. Please understand that filing for bankruptcy is a very complicated process and must be timed properly. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step.

Can we be forced to file a chapter 7 bankruptcy?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
You can spell. That is refreshing. You can articulate. That is refreshing also. You already know a lot about chapter 7. You have already figured out that income is reviewed for the past six months. Wow, someone I can actually communicate with. The income from each of the last three years will be on the schedules. It is OK for your wife to quit working all together. Bankruptcy is meant to help people, it is a system of people helping other people out of debt. No one is going to say that your wife must work, and it would not be considered an abuse of the bankruptcy laws for her to quit a high stress job and get a lower stress one. All creditors back off and the Trustees job in a chapter 7 is to find assets which are not exempt and get money for them to pay creditors a pro rata share.

HOA Field Lien

Angelo Anthony Gasparri
Answered by attorney Angelo Anthony Gasparri (Unclaimed Profile)
Bankruptcy lawyer at Gasparri Law Group
As it turns out, no.  There is a problem in the way the HOA lawyers are doing this.  The debt owed to the HOA is always assocaited with the house, but it is not in personum to you --  The lien provides the HOA with the right to collect NOW, which is a violation of your Bankruptcy discharge.  It leaves them without a way to perfect the obligation that runs with the land.   You should consult with your lawyer about filing a motion for sanctions.  We just filed one on behalf of one of our clients.
