**BEWARE** There are some incredibly unprofessional and unethical attorneys (Hope Carmichael and Catherine Bryant) in this firm who are paid by developers to pretend to represent HOAs and try to coerce actual residents to vote to give up their property rights and pay for developers’ fees disguising them as HOA fees. I’ve been in real estate for 20 years and have never come across such shady tactics violating NC attorneys ethics and code of conduct. If you are ever contacted by this group, do your research. DO NOT TRUST this firm.
She advised an HOA Board that it has no duty to maintain a common element, and that no easement exists - despite that she knows that an easement exists and that the Board has a Duty to Maintain the common element per NC Law and HOA Covenants. She knows that the Board will rely on her incorrect advice to Breach their Duty, exposing the Board to litigation that she knows will make her and her firm more money. She threatens homeowners who have not violated HOA rules with trespass, harassment, nuisance, law enforcement, and foreclosure. She has filed liens to foreclose on homes, and kick families into the streets, for $50 fines. She was a Deacon at her church, but behind the scenes her firm took nearly a half million dollars PPP $ intended for struggling businesses and employees, to pay her salary which helped finance her more than million dollar mansion of a home. Hope Derby Carmichael, Partner: 1. She advised the Carolina Preserve HOA Board that they do not have a Duty to Maintain a Common Element drain that she knows was installed by the Developer "because the drain is not located within as easement," despite knowing that the HOA has a Duty to Maintain the drain which IS located within an easement, because the CP Declaration and Covenants grant an easement over all Common Element including the entire stormwater drainage system, of which the drain is an integral part. 2. She is aware that the CPHOA is using her incorrect advice to Breach their Duty per NC Law and the CP Governing Documents, and exposing the CPHOA to litigation and liability. 3. She is aware that a former Board member, who is not a licensed NC attorney, drafted a legal document "on behalf of the HOA," and instead of reporting said behavior to the NC Bar, stated that she "assisted" said Board member in the drafting of the document, which also appears to be improp
The administrative assistant is under qualified and knows nothing, no one is ever available; and the timeliness of callbacks are terrible. I would advise their law firm to hire another receptionist, we should not be greeted with disrespect. When I'm expressing my concerns I should not be cutoff mid-sentence with I do not know and no one is available to assist you. If you do not like your job, please go elsewhere.
As a defendant, not represented by this lawyer, found that he was willing to enter false evidence, commit perjury, on behalf of his clients. This is factual, not made up and can prove these allegations. This lawyer even lied to the judge, stating that I had been served...I wasn't served till 4 days after the hearing, thus was not allowed to defend myself against the lies, false evidence, etc. that he presented on behalf of his clients.
The audacity of this firm to work for an HOA and to allow discriminating practice and negligence to be displayed to their home owners. I am offended and hurt by how this firm handles home owners and the lack of professionalism. During these times of Covid and uncertainty they have made it harder for me to believe that this world will get better. They were wrong in how they handled my home and my family knowing I have a toddler and allowing them to stand by an HOA company who knowingly has not followed the law and could have caused further damage in my home.i have paid my dues on time for the past five years and planning on moving and let them know three weeks in advance to work on my home and they have ignored my emails and replied leisurely when they felt like it. Causing stress and dismay to me and my family. The attorney and you know who you are should be ashamed of himself. No morals at all.
