The attorney is ethically required to maintain the dismissal in his or her file until the settlement is finalized, including the settlement checks are distributed and cashed. If the attorney does not, you can file a claim against them. The problem that sometimes arises is that settlements are concluded, checks are cashed and then the plaintiff never files the dismissal, leaving the defendants on the hook. If you're still concerned, tell the attorney you would be comfortable filing a notice of settlement of entire case but not a dismissal. See if they'll compromise.

Because when anyone has insurance the insurance company is contractually obligated to provide an attorney. It is smart to have an attorney at such proceedings. You should too or at the very least have consulted with one before you go to the hearing to make sure that there are no complex issues and liability and damages are clear.
