Will property owners be liable for the carpenter's injuries and why?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Personal Injury lawyer at Peters Law, PLLC
Maybe. If the club did not post no trespassing signs and the skier was on the club's property knowing that shooting was going on, then it might be liable. If the skier was not on the club property but was shot by a club member, it is possible that the club would be liable for lack of care in training its members how to shoot properly. The club member who fell may have a claim for failure to maintain the tree stand. However, the club should have as part of its membership agreement a release for any harm incurred in being a member of the club. The carpenter knew the danger and should have taken better care to not fall.

Can I get a separate attorney for a consortium?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Personal Injury lawyer at Graves Law Firm
Yes, you are free to retain a separate lawyer for your consortium claims, but depending on the case, you may not be able to find one who is willing to pursue a consortium-only claim for you.

Is it legal for a driver to prohibit the insurance company from contacting someone?

Answered by attorney Eric R. Chandler
Personal Injury lawyer at Chandler Conway, P.C., L.L.O.
It doesn't matter. If a driver rear ends another car, the accident will be deemed their fault 99% of the time. The fact that the girl he rear-ended may have been drinking is irrelevant to whose fault the accident was. Tell your boyfriend not to worry about it. His insurance will assess the damage and then pay out according to his policy.
