I cannot answer your Question (What or how much should I ask for as compensation for injury?) as I do not have enough information. There is no magic formula to determine what a case is worth. Each case is different and dependent on its owns facts and evidence. A person is entitled to be "made whole" or "compensated" for his or her injuries and damages. There are a number of factors that help determine what a case is worth, which include, but are not limited to: the nature and extent of the injury; medical expenses; whether an injury is temporary or permanent; lost wages; and pain and suffering. If an injury is permanent or will affect a person in the future, the person should receive additional money. Settlement databases and jury verdicts can help determine a range of what a case is worth. You need to find settlements or verdicts that match your case as closely as possible for these to be useful. You also need to look at settlements and verdicts in the same or similar location as you are in. For instance, if you live in a small town in Western Nebraska, settlements and verdicts from Lincoln or Omaha may not be of much use. You are talking out of both sides of your mouth. You are saying they have paid the damage in part but claiming you are in part at fault which suggests they ought not pay you anything. when you stop at a stop sign you still violate the law if you drive into the intersection and cause a wreck. You must not only stop but remain stopped until you can see the way clear. If the way is not clear you are guilty. It doesn't matter if he stopped 10 times. Sue the rascal if you care to but it sounds like a small claim that wont get much respect or attention from anybody.
