Second, any investigating authority (police) should have investigated the collision. If not, a Washington State Collision report, available on the State Patrol's website, should be completed and filed. Third, an experienced auto collision attorney should be consulted. Even of that attorney isn't hired, getting your claim evaluated by a professional is just as important as getting your injuries examined.

The District Attorneys office would have to agree to file criminal charges. Depending on the County, most District Attorneys office will not file a criminal complaint unless the police were called to the scene of the incident or the victim complains loudly enough and demands that a criminal charge be filed.
