If the insurance company did not require you to sign a release to obtain the check for the repair of the vehicle repairs, you may take the person to court for the excess. Normally the insurance company will defend their insured to the extent it takes for you to accept a settlement within the policy limits, and will not write a settlement check unless you sign a release.

Actually you have no right at all to be in the lawyers office client or not. Keep that in mind so you dont find yourself arrested. That stated, obviously, you have a bad relationship with the lawyer and it is likely that you will need to retain a new lawyer, likely at some exepense out of pocket to intervene and figure out how to address the issues with the first lawyer. Unforunately, complaining about overisghts and issues AFTER a settlement, and worse, if you are demanding some form of fee reduction or consideration is always problematic and the source of controversy. IN the future address these issues during thecase.
