How much is an average workman's comp settlement?

Answered by attorney Samuel Eugene Spital
Personal Injury lawyer at Spital Associates
There are no "average" settlements in injury cases. The truth is there are multiple factors that are relevant to the value of an individual case, including but not limited to the following: . Age of the claimant . Time and circumstances of the injury . Whether there are any third parties also liable (besides a claim against the employer), such as another vendor, manufacturer, supplier, contractor, etc. . Whether there were any pre-existing injuries . Nature and extent of the injuries . Record of other claims against the employer . Period of time unable to return to work . Whether only a temporary or permanent injury . The nature of future care, if any . The nature of future loss of employment or retraining required.

Can I be liable for injuries in my home?

Answered by attorney Earl K. Straight (Unclaimed Profile)
Personal Injury lawyer at Law Offices of Earl K. Straight
To be liable in this situation, the injured party must show that the injury was due to your negligence. The mere fact it happened in your home does not automatically make you liable. If you have homeowners insurance let them handle it. Otherwise, you will have to decide whether to fight the lawsuit or settle.

Am I being treated fairly in my personal injury case?

The less than $200 charge was a criminal matter, which does not always equate to a civil case. That said, you have every right to make this guy prove his case, including all alleged damages, so that he can only claim his actual incurred damages and not a lot of exaggerated figures. If you had auto insurance at the time, you need to let them handle it for you. Otherwise, you can decide to settle with him or not. If not, the worst thing that happens is he files a lawsuit, in which case he will have to prove his damages to the court.
