Can I sue the drunk driver that caused me neck and back pain?

Any time you get a "little money" from an insurance company, you are required to sign a release of liability. If you did not sign a release of liability, you may sue for damages if you have sustained a "serious impairment of body function. Your own insurance company must pay all your medical bills.

If I'm driving with no license in girlfriend's car and I had an accident but not my fault, she has full coverage, do I have a claim?

David B. Rechtman
Answered by attorney David B. Rechtman (Unclaimed Profile)
Personal Injury lawyer at Rechtman & Spevak
Did the other driver get a ticket? If so, the other driver's insurance company should at the least pay for damage to the vehicle. I think it's worth making an insurance claim for bodily injuries (through a lawyer) in this situation. However, because of your illegally driving the vehicle, it looks like a difficult case to take to court (unless you have severe injuries).

If the other driver was at fault, you should still be compensated for your damages even though you didn't have insurance.
