Most attorneys get 1/3 or the gross. Some take 1/3 of the net after costs are taken out . In all cases, the attorney reimburses himself for the costs of the case. The only difference is whether the attorney computes the 1/3 after reimbursing the costs or before. Contingency fee retainers are required to be in writing, and the rule that requires them to be in writing require that the agreement specify whether the percentage is applied to the gross recovery or the net recovery.

Am i liable for workers comp if a contractor is injured in my home?

You are not considered his employer for any Workers Compensation benefits he may be entitled to receive. That fact also allows him to sue you for negligence on a premises liability theory and or a negligence theory. His employer's Workers Comp insurance company can bring a direct negligence action against you for any payouts they made or will have to make for his Comp claim. Your homeowners liability policy will provide you with insurance coverage up to the limits of your policy for any action brought against you by the employee and or his Workers Comp insurance company. Depending on his injuries you may have personal asset exposure if his injuries and claims exceed your insurance limits. You should immediately contact your insurance company for a complete discussion of your rights and obligations. You may also want to contact a lawyer for a discussion of this matter. Just because he was injured on your property does not mean he would win a negligence case against you. He has to prove the property was in a dangerous condition and or you were negligent in some manner that caused his injuries. Your defense would be that he was warned about the condition of the property and that the area in which he fell was open and obvious.
