Moreover, insurance companies rarely payout the kind of money you are talking about without a lawyer representing the accident victim.

Yes you may sue. However, hopefully you made an immediate report/complaint and complained to the county health department, took pictures of your injury, and obtained the relevant employee's (management) names on duty, and saved the evidence and photographed it . Nonetheless, it is not a big claim, and you may have trouble finding an attorney willing to take the case on contingency from your description.
