AFTER A CRIMINAL CASE HOW LONG DO U HAVE TO FILE A CIVIL SUIT?

Answered by attorney Warren S. Hecht
Personal Injury lawyer at Warren S. Hecht
Depends on what is the cause of action. For example, the time for bringing an action for false arrest/imprisonment starts from the date of arrest/imprisonment while the time to bring a cause of action for malicious prosecution starts from the date that the case is dismissed.  If you are suing under state law there is a one year statute of limitations. If you are suing under Federal Law  there is a three year statute of limitations. If you are suing under state law against a municipality you have to file a notice of claim within 90 days of  false arrest/ imprisonment if making such a claim or if claiming malicious prosecution 90 days from the dismissal of charges.

What can I do if they are now using my information in a deceitful manner?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Personal Injury lawyer at Richard B. Jacobson Associates, LLC
I wish your question was a bit more detailed. I can't tell exactly who might use the information in a deceitful manner, nor what kind of deceit concerns you. Generally speaking, if you work for an entity, they are entitled to certain information about you, including your social security number. There are various remedies and penalties if some entity uses information in ways they are not supposed to do. But there is no way to answer your question without additional information.
