Since she was married, her widower and her 2 children would be entitled to compensation. Since the children were, from the fact she is only 28, minors I assume they lived with her. If they did not, that could raise some other issues. Both the husband and the current guardian of the children (if it is not the husband) should contact an attorney or attorneys to discuss their claim for wrongful death.

You must obtain a copy of the attorney/client contingency fee contract which has to be signed by the original attorney and your mother. If there is no language providing for fees over and above the percentage and costs of litigation I would say the attorney is in error asking for the additional fees. I don't know any PI lawyers charging for appearances that they can't make themselves. But I don't know all layers. Your mother has several remedies available. I would start with the contract and ask the lawyer how he justifies the extra fees.

I would ask for $400,000 and settle for anything at $200,000 or more. If you have an attorney that gets a third, then you end up with about $40,000. Without an attorney, you get about $100,000.
