You can't hold the surgeon responsible as there is a statute of repose that prohibits you from suing a health care provider more than 4 years after the negligent act, regardless of the date you discovered the negligence.

There are hearings and conferences at various stages in the litigation process. Your presence as the client is not often needed or required. Without having more information, I am unsure as to what type of hearing to which you are referring. It is my guess that if your presence was required, then you would have been notified. No, your attorney should never settle anything without running it passed you before and receiving your permission and/or authority to settle the case.
