It may depend on whether your call about the water was before the child was burned or after the child was burned, and the reason the water became so hot. You will need to show that the landlord was negligent. One way to do this is to show that there was a dangerous condition at the apartment that was known to the Landlord. If for some reason, the water heater was heating the water beyond what is safe, the landlord may be liable. If it was set at a reasonable temperature but malfunctioned, then the Landlord can argue that he was no negligent. The landlord may still be liable because a landlord has a duty to maintain the residence in a reasonably safe condition, and this might be a breach of that duty.

Sure, you can be sued for anything. The entity should indemnify you but if it doesn't have any money, that may not mean much. If you are really worried, ask what kind of liability insurance it has.
