Can’t we, as parents not use the settlement money for our daughter’s benefit as we see fit?

The availablity of different options may depend on your jurisdiction. I have had a parent place trust funds in a 529 plan, I have had provisions when the account is turned over at age 21 and not 18, and I have arranged for structured settlements, where payments are made by the insurance company directly to the injured party after attaining the age of majority in several installments over a period of years. Special needs can be considered, such as orthodontia, but only if there are no other sources available, such as insurance. Stuff like new bedroom suite/camps/etc. is out of the question. Settlements involving minors must be approved by a court and can only be changed by court order, for good cause shown, and of course the petitioning party would have to convince the judge that any change is a necessity for the minor.

Why would I need a subpoena to get a copy of a police report involving my sister’s death which is supposed to be a suicide?

Generally police reports are public records and you should be able to get it directly or by a Freedom of Information Act (FOIA) request. Have the police explain to you why your request is being denied if they don't change their mind and then you can consult with an attorney re: the next step. Certainly if there is any Probate action, you can get a Subpoena from that court if the report is relevant to the proceedings/claims.

You can't sue for the loss of income, the damages are considered "remote" and "specuative" (I know that to you they aren't but that's how it's looked at legally). You might be able to sue the testing company for "specific performance", that is, getting the scores to the state, and possibly bring an "Article 78 proceeding" to compel the state to process the application. Hopefully, it woun't come to that, perhaps a few letters and phone calls from a lawyer can straighten it out.
