If an estate of the wrongdoer has not been set it, it needs to be. An action can than be maintained against the wrongdoer's estate. You need an attorney to work through this process.

Can a suit be filed against the company that made the equipment that we repeatedly asked to be replaced due to being unsafe?

Sorry, but there is not enough information to answer this question. Generally Michigan law allows suits against negligent manufacturers and/or maintainers of equipment; however, there can be proof and/or cost problems in bringing such suits. There can also be limitations on liability and/or damages, depending on the circumstances of the particular case. Generally you may not sue your employer in tort for on the job injuries, but you may collect workers compensation. As I routinely point out in my answers, each case/situation is fact dependent on what you may/may not do, how viable a case/claim is, etc., so it is always best in my opinion to contact local Michigan counsel for a free consultation regarding your specific situation/facts to get more precise advice.
