Can I sue the school for failing to report child on child molestation?

I think our question involves two issues: 1) is the school liable for not preventing this? This depends on whether the school was negligent in supervision the children, which involves whether they breached any codes or regulations (such as any regulations requiring a certain ratio of teachers/caretakers to children), or whether the breached any standards that are normally observed in that industry (pre-school/daycare), such as always having an adult in a position to observe children on the bus (I'm not saying this is actually a standard, but giving this as an example of something you might be looking for). Finding laws, regulations or regularly observed standards that were breached helps establish negligence. Sometimes negligence can be established by commons sense. For example, you don't stock your daycare center with dangerous toys that can injure children, or you don't expose the children to an obvious hazard, such as an open flame, or other hot object. For what you state here, I cannot say whether the school was negligent. The second question is whether the school has any liability for failing to inform you. I do think the school should have informed you earlier, and I think you should be seeking an explanation from someone as to why you were not informed (perhaps there is an explanation, but I cannot think of one). I'm not sure the school had an absolute legal duty to inform you. The school does have a legal duty to report suspected sex abuse to the Department of Social Services, but that probably applies only to abuse by an adult to a child. The school should probably have reported the other child's behavior to DSS, not as a perpetrator, but as a suspected victim of abuse because the child may be mimicking what has been done to him by an adult. I do think you could argue that the school was negligent in not informing you (this is probably one of those breaches of a common sense rule). However, you also have to prove that this negligence caused damages. Whatever trauma your son has suffered, it is probably no worse that it took approximately a month for you to learn of it. However, I am not a counselor or child psychologist, and this is a question for that person to answer. Unless the school was negligent in failing to prevent the "molestation", their failure to notify you would not make them liable for the damages caused by the molestation, but they would only be responsible to the extent the damages was aggravated or made worse by the failure to report. I suspect that there is not much of a civil case here, but it depends on how severe the trauma is (hopefully not severe), whether the school was negligent in not preventing it, and whether the failure to notify you made the trauma worse.
