She could file suit against him, but under the circumstances, It will be hard for her to prove her case. Since the lady did not cooperate with the officer, you should notify your insurance company of the possible claim, and let them handle the matter so that your husband is not talking with the lady directly. If he talks with an attorney, the likelihood of an attorney taking her case is slim.

But you can contact your county Justice Court and learn how to file a lawsuit yourself. It's just like Peoples Court on tv. This will make the adjuster take your case more seriously.
