I believe 4 years, but you normally need to serve a written demand on the police department first pursuant to Florida Statute.

I assume this was the hotel's iron. If so, the hotel is legally liable and it is the hotel's insurance company that provides coverage for their liability. If you want to get a financial recovery, hire a lawyer, that's what we do. This will include not only pain and suffering, but out of pocket expenses, uncovered medical bills and time out of work. Most likely, a formal lawsuit will not be required, but the insurance company will not take you seriously unless they know that unless they do settle, a lawsuit could be in the offing.
