Simply because you were allergic to food served at a restaurant does not give you the right to make a claim against the restaurant. I would try to get them to re-open the file and reinstate their offer, otherwise you will hire another attorney and file suit. Hopefully, they will put the money back on the table. If you proceed pro se, (representing yourself) do you think you can prove they were negligent? Again, simply because you had an allergic reaction does not mean you are entitled to be compensated by the restaurant unless they were negligent or their food was adulterated somehow (and can you prove that?).

Probably not. Likely, the investigator was on a public sidewalk and they can do what they want. The bar owner would have to prove damages. But, she could hire a lawyer to write a "cease and desist" letter.
