Do we have grounds for a malpractice suit?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
Probably but the issue might be damages. If you dont have a serious injury you will waste time and money. You will have to have a doctor to be an expert witness and his fees and expenses will be several thousand dollars. So you don't sue a medical facility unless you are prepared for a fight and can afford it.

Can I sue a gas station if I fell on their property?

Setting aside whether the station has liability, if your injuries are not significant, the cost of bringing a case will make it so that it is not economical for an attorney to take the case as costs run into the thousands of dollars and you are compensated, if there is liability, based on the nature and extent of your actual injuries.

How much would my personal injury case be worth?

Gary L. Montgomery
Answered by attorney Gary L. Montgomery (Unclaimed Profile)
Personal Injury lawyer at Montgomery Dowdle Law
Sounds like you have a substantial injury from the accident. There is no set formula for determining damages (what your case is worth) since there are many factors to consider such as the total medical bills, the nature and extent of the injuries, type of surgery, any ongoing disabilities, pain and suffering, loss of enjoyment of life activities, etc. A lot of this will depend on the opinions given by your doctors with respect to your injuries and your prognosis. A better answer could be given with more details. With that said, it appears from what you've said that you have suffered major injuries, the affects of which are likely permanent. Your case could easily be worth several hundred thousand dollars over and above the medical expenses.
