It depends on the wording of the contingent fee contract, but usually the answer is NO. You only have to pay them if they make a recovery for you, but if they have expended out-of-pocket costs, then if the contingent fee contract calls for you to reimburse them, then yes. I never ask my clients for money unless I am successful in obtaining a recovery for them.

Without knowing your geographic area, I would recommend that you ask your workers' comp lawyer to refer you to a good personal injury lawyer. I would be quite surprised if he or she can't direct you to one.

If you are an employee of the hospital tell them you want a form for a workers' compensation injury. If that is what it is get a workers' comp. attorney. Write down just what the hospital people said in detail, day and hour and get names. Write down in detail just what happened.
