First, I would consult a lawyer regarding your homeowner's response that the insurance doesn't cover it. Unless there is a disclaimer in the policy, I would think your homeowner's insurance should cover it. You may want to approach them before they get a lawyer and offer to pay the medical bills......once a lawyer gets involved, he or she is going to add tens of thousands of dollars in "pain and suffering" to the tab.

Feel free to consult with a personal injury attorney familiar with medical malpractice cases, but the obstacle I can't see you overcoming is whether the delay in diagnosis (which doesn't sound like very long from your question) made any significant difference in the ultimate outcome. If it was many months, that may be one thing but if it was only a few weeks, no doctor is going to say that may a difference in the outcome.

I did not know avocados had stems. I have only seen them without. It is true that you don't get perfection in a restaurant. Certain foods have seeds and such, and generally there is no liability. Your real problem might be causation. did the stem actually cause the problems you are having. Do your doctors confirm this. Is it possible you were predisposed to this problem? What does the doctor say about all this? And doctors don't have all the answers. They just want you to think they do.
